2. Acceptance of These Terms

By accessing or using this Website, you agree to these terms and conditions. If you do not agree with them, you should not use the Website.

These terms govern use of the Website. Separate terms may apply when you:

  • appoint Cape Yachts to sell a boat;

  • purchase a new or used boat;

  • purchase parts, equipment or other products;

  • book maintenance, servicing or other marine services; or

  • enter into another agreement with Cape Yachts.

Where separate written terms have been agreed, those terms will take precedence in relation to the relevant service or transaction.

3. Website Availability

We aim to keep the Website accurate, secure and available. However, we do not guarantee that the Website, or any part of it, will always be available or operate without interruption.

We may suspend, withdraw, update or restrict access to any part of the Website without notice where reasonably necessary, including for maintenance, security or business reasons.

4. Information on This Website

The content of this Website is provided for general information only. Although we take reasonable care when preparing and updating content, it should not be treated as technical, legal, financial, insurance or safety advice.

You should obtain appropriate professional advice and carry out your own checks before relying on information published on the Website or making a decision concerning a boat, product or service.

Boat specifications, equipment lists, dimensions, performance information and other technical details may vary between individual vessels. Prospective buyers should verify any information that is important to their purchasing decision.

5. Boats Advertised for Sale

Boat listings may relate to:

  • boats owned by Cape Yachts;

  • new boats offered by Cape Yachts;

  • boats offered for sale by private owners or other third parties; or

  • boats marketed by Cape Yachts in its capacity as a broker.

Unless expressly stated otherwise, Cape Yachts acts as an intermediary when marketing a brokerage boat and is not the boat’s owner.

Listing information may be based on details supplied by the seller, previous owners, manufacturers or other third parties. We take reasonable steps to present information accurately but cannot guarantee that every description, specification, photograph, service record or statement is complete or free from error.

A listing does not constitute a survey, valuation, warranty or guarantee of a boat’s condition, seaworthiness, compliance, ownership history or suitability for a particular purpose.

Prospective buyers are responsible for:

  • inspecting the boat;

  • confirming its specification, inventory and condition;

  • checking ownership and available documentation;

  • arranging an independent marine survey where appropriate;

  • checking registration, finance, tax and VAT status;

  • obtaining suitable insurance; and

  • satisfying themselves that the boat is suitable for its intended use.

Nothing in these terms excludes any responsibility or legal right that cannot lawfully be excluded.

6. Prices and Availability

Prices and availability shown on the Website may change without notice.

Unless stated otherwise:

  • advertised prices are asking prices only;

  • an enquiry does not reserve a boat;

  • a boat remains available until a binding sale agreement has been completed or a reservation has been expressly confirmed;

  • delivery, transport, storage, launching, survey and other associated costs are not included; and

  • VAT treatment will depend on the boat, product, service and transaction concerned.

Obvious pricing or description errors are not binding. If an error affects an enquiry or proposed transaction, we will explain it before accepting an order or entering into an agreement.

7. Enquiries, Offers and Contracts

Submitting an enquiry form, requesting a valuation, arranging a viewing or making an offer through the Website does not automatically create a binding contract.

A contract will only arise when the relevant parties have agreed the material terms and any required written agreement, deposit or payment has been accepted.

Do not send a deposit or other payment unless the payment instructions have been confirmed directly with Cape Yachts using trusted contact details. You should independently verify any unexpected change to bank details before making payment.

8. Viewings, Surveys and Sea Trials

Viewings, inspections, surveys and sea trials are subject to prior agreement, availability, weather, location, insurance and any requirements imposed by the owner, marina or Cape Yachts.

Nothing published on the Website creates an entitlement to use, operate or independently test a boat. Any sea trial or demonstration must be arranged separately and may be subject to additional terms, identification checks, evidence of competence and an agreed deposit or financial commitment.

Prospective buyers and their appointed surveyors are responsible for their own costs unless otherwise agreed in writing.

9. Selling a Boat Through Cape Yachts

Information about our brokerage services is provided for general guidance. Submitting a valuation or brokerage enquiry does not appoint Cape Yachts as broker.

A seller appoints Cape Yachts only after the parties enter into a separate brokerage agreement setting out the services, fees, duration, cancellation rights and responsibilities of each party.

Any estimate or suggested asking price is an opinion based on the information available at the time and is not a guarantee that the boat will sell or achieve a particular price.

10. Intellectual Property

Unless otherwise stated, Cape Yachts owns or is licensed to use the Website’s content, including its text, branding, photographs, videos, graphics, layouts and designs.

You may view and print Website content for your personal, non-commercial use. You must not copy, reproduce, republish, distribute, modify, sell or commercially exploit any part of the Website without our prior written permission.

Boat owners and other contributors retain ownership of material they supply but grant Cape Yachts permission to use, edit and publish that material for marketing and providing the relevant services.

“Cape Yachts” and associated branding must not be used in a way that suggests an affiliation, endorsement or commercial relationship without our written consent.

11. Acceptable Use

You must not:

  • use the Website unlawfully or fraudulently;

  • attempt to gain unauthorised access to the Website or its systems;

  • introduce viruses, malware or other harmful material;

  • scrape or systematically extract Website content without permission;

If you use the Website for business purposes, Cape Yachts will not be liable for loss of profit, revenue, business, contracts, anticipated savings, goodwill, data or any indirect or consequential loss, to the fullest extent permitted by law.
